1) Acceptance of Terms

These Terms and Conditions (the "Terms") govern your access to and use of Simple Photo Gallery (the "Service"), a platform that allows users to upload, store, and share photos and videos. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2) Definitions

- "Content" means photos, videos, captions, and other material you upload or create using the Service.

- "Public Gallery" means a gallery that is accessible to anyone with the link. Public galleries may be indexed or shared by recipients of the link.

- "Private Gallery" means a gallery restricted to you and invited viewers (feature availability may vary; private galleries may be introduced or changed over time).

3) Eligibility and Account

You must be able to form a binding contract in your jurisdiction to use the Service. When you create an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately of any unauthorized use.

4) User Content and Your License to Us

You retain ownership of your Content. You grant Simple Photo Gallery a worldwide, non‑exclusive, royalty‑free license to host, store, process, transmit, display, and create non‑substantive technical copies of your Content solely as necessary to operate, improve, and provide the Service (including to generate thumbnails, transcode media, and enable sharing features you use).

You represent and warrant that you have all rights necessary to upload and share the Content, and that your Content and your use of the Service comply with these Terms and all applicable laws.

5) Public vs. Private Galleries

Public galleries can be accessed by anyone who has the link, and recipients may reshare the link. Do not upload Content to a Public Gallery unless you intend to make it accessible to anyone with the link. Private gallery features, if available, allow you to restrict access to invited viewers; however, no system is perfectly secure, and recipients can capture or re‑share Content outside the Service.

6) Prohibited Content and Conduct

You are solely responsible for your Content. You may not upload, post, or share Content that is illegal, infringing, or otherwise violates these Terms, including without limitation:

  • Child sexual abuse material (CSAM) or any sexual content involving minors
  • Non‑consensual, exploitative, obscene, or sexually explicit content
  • Content that promotes or depicts illegal activities, extreme violence, or gore
  • Hate speech, harassment, threats, or incitement of violence
  • Content that infringes copyrights, trademarks, or other intellectual property rights
  • Invasive content that violates privacy or publicity rights, including doxxing
  • Malware, phishing, spam, or attempts to bypass security measures

Simple Photo Gallery does not endorse and is not responsible for Content posted by users. We may, but have no obligation to, monitor, remove, or disable access to Content that we believe violates these Terms or the law.

7) Reporting, Moderation, and Takedowns

If you believe Content violates these Terms or your rights, please contact us through our support channels. We may remove Content, suspend or terminate accounts, and/or report illegal content to law enforcement. If you are a rights holder asserting copyright claims, please contact us with sufficient detail so we can assess your request.

8) Plans, Subscriptions, and Billing

We offer a free tier with limitations (for example, storage or upload limits) and paid subscriptions that provide additional capacity or features. Pricing and plan limits will be presented at purchase and may change prospectively. Paid subscriptions typically renew automatically each billing cycle unless you cancel in accordance with the instructions provided in your account or purchase flow.

  • Taxes may apply depending on your location and will be shown where required
  • Cancellations take effect at the end of the current billing period unless stated otherwise
  • We use a third‑party payment processor; we do not store full payment details
  • Refunds, if any, are handled per the terms shown at purchase or required by law

9) Storage, Uploads, and Bandwidth

We may set or adjust storage, file size, bandwidth, or rate limits for free and paid plans. Abuse of the Service (for example, using automated systems beyond permitted API use) may result in throttling or account action.

10) Intellectual Property

The Service and all materials we provide (excluding your Content) are the property of Simple Photo Gallery or our licensors and are protected by intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

11) Third‑Party Services and Analytics

We use third‑party services, including analytics providers, to help operate and improve the Service. These providers may set cookies or collect usage and device information as described in our Privacy Policy. Use of third‑party services is subject to their own terms and privacy policies.

12) Disclaimers; Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Simple Photo Gallery DOES NOT CONTROL OR ENDORSE USER CONTENT AND IS NOT RESPONSIBLE OR LIABLE FOR ANY CONTENT POSTED BY USERS OR FOR ANY LOSS OR DAMAGE RESULTING THEREFROM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Simple Photo Gallery AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

13) Indemnification

You agree to defend, indemnify, and hold harmless Simple Photo Gallery and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your Content or your violation of these Terms or applicable law.

14) Termination

We may suspend or terminate your access to the Service at any time, including for violation of these Terms or suspected unlawful conduct. You may stop using the Service at any time. Upon termination, the rights and licenses granted to you will cease immediately, but Sections intended to survive will remain in effect.

15) Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required by law. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
